Wrongful Death

A Wrongful Death is a premature death caused by the act or failure to act of another person. The "Estate" of the deceased and the Family of the deceased have a claim against the "at-fault" person for pain and suffering, loss of income, loss of support, loss of love and companionship (known as loss of consortium), and other damages.

Generally, a Wrongful Death claim exists in addition to the Personal Injury claim arising out of the action that caused the harm. (For example, prescribing the wrong medicine is Medical Malpractice whether or not a Wrongful Death occurs.)

Minor Injury ~ Soft Tissue (MIST)

Until a person is involved in a motor vehicle accident most car occupants are unaware of the tremendous dynamic forces involved in a typical auto accident. At times, serious injury occurs even in minor “property damage” accidents, i.e. little or no damage to either or both vehicles.

Recent Accident and Injury Data

According to NHTSA, deaths and injuries resulting from motor vehicle crashes are the leading cause of death for persons from age 2 through 33 years-and old. In 2013, 32,719 people died in motor vehicle traffic crashes in the United States, a 3.1-percent decrease from the 33,782 fatal-ities in 2012. This decline shows a continuation in the general decline in fatalities that started in 2006, except for the increase in 2012, according to NHTSA’s Fatality Analysis Reporting System (FARS).

The Other Driver Is Uninsured (UM) or Is Underinsured (UIM)?

Over the years clients have asked: “Why should I buy Uninsured Motorist coverage (UM) in case someone hits me. Isn’t that the other driver’s job.” The truth is you are insuring yourself in case the at-fault driver has no insurance, minimal insurance or drives off in a hit-and-run situation. The goal is to protect yourself.  In situations like this your only hope for a financial recovery is from your Uninsured Motorist (UM) coverage.

Medicaid & Medicare

Medicare and Medicaid ~ what is the difference? Medicare is a “threshold” program. When a person becomes age 65, he or she is automatically eligible for the Medicare health insurance program established by Congress. Medicaid is a “needs-based” program. Medicaid is federal money given to each of the states. Each state, like Georgia, establishes the terms under which a Medicaid recipient qualifies for aid.

Elder Law ~ For Our Seniors

I am David Danda.  When my father’s Alzheimer’s no longer allowed him to stay home and my mother faced a $7,000 a month nursing home bill, I founded Danda Elder Law.

I help seniors reduce the crippling financial effects of long-term care on their families through Medicaid Planning and VA Benefit Applications, so that our Seniors do not outlive their money and so that our Seniors can leave a financial legacy for their families.

In Criminal Litigation the Federal or State government prosecutes someone charged with a crime by asking the court to determine his or her guilt. A Personal Injury (PI) is any physical or mental injury to a person as a result of another person's negligence or harmful act. Many insurance companies refer to Personal Injury as Bodily Injury (BI). Estate Planning

Most Americans worked hard all their life.  They bought a home, had a family, raised and educated their children, and still managed to put money away for the future. Our seniors’ biggest fear is that their hard-earned money will go to that political “black hole” known as Washington, DC. Your goal while working was to save money for retirement and leave a legacy for your children. Clearly, all honest hard-working seniors believe in the concept: “I earned it, I paid taxes on it, I saved it, and my money should go to my family.” Your goal then, and even more so now, is to utilize the provisions built into the tax code to your advantage.
